- Complete the profile (including your birthday, address) and the additional profile information in the portal.
- My assistant will make sure your profile is set as an active client, if it has not yet been done so.
- Review, sign and return the ICF Agreement and CC Authorization – Please indicate how many sessions per month you wish to start with. The Discovery and Planning Session will be billed prior to our meeting. For ease, you can sign this by computer. Please return as soon as possible and at least 24 hours before our session. If these are not received 24 hours before our session we will have to reschedule.
- Please complete as much or as little as you want on the Client Questionnaire. The Questionnaire is to get you thinking and to provide me with additional information about you. Please return this by 5 pm ET the day before our Discovery and Planning Session.
- Many clients also find the Characters Strengths Assessment helpful. It is a free assessment you can find at http://DanaMaherCoaching.pro.viasurvey.org. It takes 15 to 20 minutes to do. The top 5 to 7 strengths are the ones we use consistently and will appear over and over through our days and lives. The rest of the 24 strengths are strengths we all have but we use situationally. We will be using this throughout our work together.

ICF COACHING AGREEMENT
This Agreement is entered into by and between: Dana Maher Coaching LLC (Coach) 1130 Raritan Road, Suite 2, Cranford, New Jersey 07016 and $FIRSTNAME$$LASTNAME$ (Client) whereby Coach agrees to provide Coaching and Consulting Services for Client. Client is retaining Michael Frolichstein Dana D, Maher as their coach, This Agreement covers all coaches employed or contracted by Dana Maher Coaching, LLC.
Description of Coaching: Coaching is partnership (defined as an alliance, not a legal business partnership) between the Coach and the Client in a thought-provoking and creative process that inspires the client to maximize personal and professional potential. It is designed to facilitate the creation/development of personal, professional or business goals and to develop and carry out a strategy/plan for achieving those goals. Coaching is not a quick fix and the minimum industry recommended commitment to coaching is 3 months.
1) Coach-Client Relationship:
- Coach agrees to maintain the ethics and standards of behavior established by the International Coach Federation “(ICF)”. International Coach Federation Code of Ethics. It is recommended that the Client review the ICF Code of Ethics and the applicable standards of behavior.
- Client is solely responsible for creating and implementing their own physical, mental and emotional well-being, decisions, choices, actions and results arising out of or resulting from the coaching relationship and their coaching calls and interactions with the Coach. As such, the Client agrees that the Coach is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by the Coach. Client understands coaching is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease.
- Client further acknowledges that Client or Coach may terminate or discontinue the coaching relationship at any time on two weeks written notice.
- Client acknowledges that coaching is a comprehensive process that may involve different areas of his or her life, including work, finances, health, relationships, education and recreation. The Client agrees that deciding how to handle these issues, incorporate coaching principles into those areas and implementing choices is exclusively the Client’s responsibility.
- Client acknowledges that coaching does not involve the diagnosis or treatment of mental disorders as defined by the American Psychiatric Association and that coaching is not to be used as a substitute for counseling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical or other qualified professionals and that it is the Client’s exclusive responsibility to seek such independent professional guidance as needed. If Client is currently under the care of a mental health professional, it is recommended that the Client promptly inform the mental health care provider of the nature and extent of the coaching relationship agreed upon by the Client and the Coach.
Client is employing Coach as a professional coach.
Dana D. Maher, owner and coach, is also a licensed Attorney at Law of New Jersey, but she is not being employed by Client as an attorney at law and is not representing Client in any legal capacity. Nothing said during the coaching relationship shall be construed as legal advice or legal opinion.
- The Client understands that in order to enhance the coaching relationship, the Client agrees to communicate honestly, be open to feedback and assistance and to create the time and energy to participate fully in the program.
2) Services:
The parties agree to engage in a one on one Coaching Program and additional services as may be required within the scope of coaching and consulting services through telephone and video meetings. Coach will be available to Client by e-mail, text and voicemail and an occasional 10 - 15 minute calls between scheduled meetings. Coach may also be available for additional time, per Client’s request on a prorated basis at the rate of $325 an hour for Coach Dana D. Maher $135.00 an hour for Coach Michael Frolichstein (for example, reviewing documents, reading or writing reports, engaging in other Client related services outside of coaching hours).
3) Schedule of Fees for Coach Dana D. Maher:
This coaching agreement is valid as of (insert date). The fee is $495 for a one time 90 minute Discovery and Planning Session and $550 for 2 sessions a month, $750 for 3 sessions a month or $925 a month for 4 times a month and billed on or before the first session. You may change the number of sessions per month for the upcoming month, by notifying your coach by 5 pm ET on the last business day of the month.
The regular coaching sessions shall be up to 50 minutes (except for the one time 90 minute Planning and Discovery Session)..
If rates change before this agreement has been signed and dated, the prevailing rates will apply.
3) Schedule of Fees for Coach Michael Frolichstein:
This coaching agreement is valid as of (insert date). The fee is $195 for a one time 90 minute Discovery and Planning Session and $275 for 2 sessions a month or $395 for 3 sessions a month and billed on or before the first session. You may change the number of sessions per month for the upcoming month, by notifying your coach by 5 pm ET on the last business day of the month.
The regular coaching sessions shall be up to 50 minutes (except for the one time 90 minute Planning and Discovery Session).. If rates change before this agreement has been signed and dated, the prevailing rates will apply.
4) Procedure:
The time of the coaching meetings and/or location will be determined by Coach and Client based on a mutually agreed upon time via phone or video conferencing. The contact phone number or link will be supplied by the Coach. If the Coach will be at any other number for a scheduled call, Client will be notified prior to the scheduled appointment time.
5) Confidentiality:
This coaching relationship, as well as all information (documented or verbal) that the Client shares with the Coach as part of this relationship, is bound by the principles of confidentiality set forth in the ICF Code of Ethics. However, please be aware that the Coach-Client relationship is not considered a legally confidential relationship (like the medical and legal professions) and thus communications are not subject to the protection of any legally recognized privilege. The Coach agrees not to disclose any confidential information pertaining to the Client without the Client’s written consent or as required by law. The Coach will not disclose the Client’s name as a reference without the Client’s consent.
Confidential Information does not include information that: (a) was in the Coach’s possession prior to its being furnished by the Client; (b) is generally known to the public or in the Client’s industry; (c) is obtained by the Coach from a third party, without breach of any obligation to the Client; (d) is independently developed by the Coach without use of or reference to the Client’s confidential information; or (e) the Coach is required by statute, lawfully issued subpoena, or by court order to disclose; (f) is disclosed to the Coach and as a result of such disclosure the Coach reasonably believes there to be an imminent or likely risk of danger or harm to the Client or others; and (g) involves illegal activity. The Client also acknowledges their continuing obligation to raise any confidentiality questions or concerns with the Coach in a timely manner.
6) Release of Information:
The Coach engages in training and continuing education pursuing and/or maintaining credentials through ICF (International Coach Federation), PAAC (Professional Association of ADHD Coaches) and/or any other training and/or credentialing organization. That process requires the names and contact information of all Clients for possible verification by the ICF or other training or credentialing organization. By signing this agreement, you agree to have only your name, contact information and start and end dates of coaching shared with staff members and/or other parties involved in this process for the sole and necessary purpose of verifying the coaching relationship, no personal information or notes will be shared.

According to the ethics of our profession, topics may be anonymously and hypothetically shared with other coaching professionals for training, supervision, mentoring, evaluation, and for coach professional development and/or consultation purposes.
6a) Permission to Record and Submit Coaching Sessions
For the purposes of educational or professional development and/or for credentialing, Coach will be required to produce an audio or video recording of a coaching session with a client and a written transcript of the session. Any student, mentor, trainer, or assessor, including the coach who reviews the recorded session will handle all information with the highest level of confidentiality under the Policies and Procedures of ADDCA (the ADD Coach Academy), ICF (the International Coach Federation) and PAAC (the Professional Association of ADHD Coaches) Code of Ethics, Standards and Codes of Conduct. No personal information, except what is contained in the recording will be shared. I am requesting your permission to record our coaching sessions and submit recordings and transcript for my educational growth, professional development, and/or credentialing purposes.

7) Cancellation Policy:
Client agrees that it is the Client's responsibility to notify the Coach 24 hours in advance of the scheduled calls/meetings. Coach reserves the right to bill Client for a missed meeting. Coach will attempt in good faith to reschedule the missed meeting. Group Coaching Sessions can not be made up or rescheduled.
8) Record Retention Policy:
The Client acknowledges that the Coach has disclosed the following record retention policy with respect to documents, information and data acquired or shared during the term of the Coach-Client relationship. Such records will be maintained by the Coach in a format of the Coach’s choice (print or digital/electronic) for a period up to one month from the date of the last session.
9) Termination:
Either the Client or the Coach may terminate this Agreement at any time with 2 weeks written notice. Client agrees to compensate the Coach for all coaching services rendered through and including the effective date of termination of the coaching relationship.
10) Limited Liability:
Except as expressly provided in this Agreement, the Coach makes no guarantees, representations or warranties of any kind or nature, express or implied with respect to the coaching services negotiated, agreed upon and rendered. In no event shall the Coach be liable to the Client for any indirect, consequential or special damages. Notwithstanding any damages that the Client may incur, the Coach’s entire liability under this Agreement, and the Client’s exclusive remedy, shall be limited to the amount actually paid by the Client to the Coach under this Agreement for all coaching services rendered through and including the termination date.
11) Entire Agreement:
This document reflects the entire agreement between the Coach and the Client and reflects a complete understanding of the parties with respect to the subject matter. This Agreement supersedes all prior written and oral representations. The Agreement may not be amended, altered or supplemented except in writing signed by both the Coach and the Client.
12) Dispute Resolution:
If a dispute arises out of this Agreement that cannot be resolved by mutual consent, the Client and Coach agree to attempt to mediate in good faith for up to 30 days after notice given. Mediation will be through the American Arbitration Association or as otherwise agreed upon by the Client and Coach. If the dispute is not so resolved, and in the event of legal action, the prevailing party shall be entitled to recover attorney’s fees and court costs from the other party.
13) Severability:
If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If the Court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.
14) Waiver:
The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Agreement.
15) Applicable Law:
This Agreement shall be governed and construed in accordance with the laws of the State of New Jersey, without giving effect to any conflicts of laws provisions.
16) Binding Effect:
This Agreement shall be binding upon the parties hereto and their respective successors and permissible assigns.

Coaching Policies
Confidentiality
We take confidentiality very seriously. Our sessions are kept in the strictest of confidence. We will not share any information about you or what we discuss in our sessions, except to the extent outlined in the Coaching Agreement for training/credentialing purposes or in an instance of health or safety. If someone who referred you to me asks how you are doing, my standard answer is they are doing well.
Phone Calls, Texts and Emails
We are here for you. Should you need to call, text or email, please do. We make my best effort to respond promptly, unless on vacation or have a family emergency/obligations. Do not worry about reaching out to us, if the calls, texts and emails become unreasonable or excessive, we will discuss it.
Coaching with Dana by Phone (Video conferencing and in person can be requested at least 24 hours prior to the session)
The client is expected to call 908-967-9611 (this is my dedicated coaching line and can not receive texts) at the scheduled appointment time, unless other arrangements are made.
Coaching in Person
For in-person sessions, the client is expected to arrive on time at Dana’s office. for all sessions. If the client is late, then the client may not get the entire session time and may only get the remaining time of their scheduled session.
Coaching with Michael by Video Conferencing
The client is expected to join the video call at the scheduled appointment time, unless other arrangements are made.
If the client calls in late, then the client will not get the entire session time and will only get the remaining time of their scheduled session.
Payment Policy
- Discovery and Planning Session and remaining sessions for the current month are billed on or before the first session.
- Sessions for the month are billed on the first of the month for the upcoming month.
- If you want to change the number of sessions per month or discontinue coaching, please advise in writing, by 5 pm of the last business day of the month.
- It is the client’s responsibility for making sure all sessions are scheduled and used for the month.
Session Scheduling and Length
It is up to you to schedule your sessions. We try to schedule for the upcoming month on our last session of the current month. Most people do best with a regularly scheduled day and time. The length of a session is in accordance with the coaching agreement. Sometimes the entire length of time is not necessary and sometimes if there is not another appointment scheduled directly after your appointment, the session may run longer.
Session Cancellation
- If the session is cancelled at least 24 hours prior to the session, there is no cancellation charge and it does not count as a used session, We will do my best to reschedule your appointment the same week.
- If the session is cancelled with less than a 24 hour notice or an appointment is missed, then it counts as a used session.
- Not completing your Action Plan is not a reason to cancel. It may provide a topic to be coached on or may not have been the right assignment for you at the time.
Introductions & Feedback
We rely on introductions for our business, if you are happy with our services then please share our information with the people you know. We may ask if we may use you as a reference for potential clients, and you may decline if you are not comfortable with that. We welcome all testimonials and recommendations.
We welcome any and all feedback. We want to be the best coaches we can possibly be. We can have a feedback session or you may call, text or email me at any time.
Termination Process: When you plan to conclude or terminate our sessions, please let me know as soon as possible so we can schedule a wrap up session as your final session.
